The Right to Privacy and its Protection against Discrimination in Access to Financial Services: Zcash as an Opportunity for Mexico and Latin America.

Privacy is a fundamental right, enshrined and recognized in international treaties such as the Universal Declaration of Human Rights, the Inter-American Convention on Human Rights, and others (to learn more about the legal framework of the right to privacy). This right protects the privacy of individuals and allows for control over personal information, preventing sensitive data from being used for discrimination, victimization, censorship, and enabling individuals to have autonomy over their decisions and exercise their right to self-determination. Therefore, the protection of the right to privacy is crucial as it enables the exercise of other rights.

In this instance, I will refer to the Mexican case; however, Mexico is a good example of a situation that extends throughout Latin America, where 41.6% of people do not have access to a bank account. In Mexico, 49.1% of people between the ages of 18 and 70 have a bank account.

Discrimination in access to financial services, such as access to bank accounts, loans, and insurance, is a structural problem in Mexico and other countries in the region. According to the study "Financial Inclusion without Discrimination: Towards an Inclusive Treatment Protocol in Mexican Bank Branches" by Martínez and Reséndiz, women, young people, indigenous peoples, Afro-descendants, the elderly, people with disabilities, and social program beneficiaries are the sectors most affected by financial discrimination.

Physical appearance, clothing, skin tone, employment status, place of residence, and income level also influence financial exclusion. That is, a wide range of people is excluded from financial services for unjustified reasons, reinforcing the lack of opportunities and poverty in this already impoverished sector.

Privacy in Financial Services

Privacy in access to financial services is essential to protect individuals from discrimination and ensure equal opportunities for all. The disclosure of personal data can lead to financial exclusion, as financial service providers may use this information to deny access to certain groups of people based on their personal, cultural, ethnic, racial, or socio-economic characteristics.
In this scenario, it is necessary to develop financial instruments that guarantee individuals' privacy to access discrimination-free financial services. One such instrument could be the cryptocurrency Zcash, which offers a private and anonymous transaction mechanism.

Zcash as a Tool Against Discrimination and Access to Financial Services in Mexico

Zcash is a cryptocurrency that uses advanced cryptography to protect transaction privacy and ensure user anonymity. Unlike other cryptocurrencies like Bitcoin, Zcash allows users to hide information about the sender, receiver, and transaction amount, preventing discrimination based on users' personal data.

In the Mexican context, Zcash can be an opportunity to improve access to financial services and reduce discrimination. By protecting individuals' identities, Zcash removes barriers related to physical appearance, skin tone, place of residence, ethnic affiliation, and sexual preferences, allowing users to access financial services free from the barrier of discrimination, contributing to poverty reduction and the exercise of other human rights.

Conclusion

The right to privacy is fundamental for individuals to fully exercise their financial rights. The adoption of instruments like Zcash can be an effective solution to make the exercise of rights accessible to vulnerable populations and promote financial inclusion, consequently enabling the exercise of other related rights.

However, it is important to note that the adoption of cryptocurrencies also poses legal and security challenges. Therefore, it is essential for governments and financial regulation agencies to establish legal frameworks that provide certainty to users and protect their rights.

Finally, the protection of the right to privacy and the fight against discrimination are closely linked issues. In this sense, a combination of measures is required, including the promotion of financial instruments like Zcash and the implementation of public policies that ensure equal opportunities and non-discrimination.
